By using MagiBooking, you agree to these terms. These terms should be reviewed periodically for applicable company policies, state law, privacy requirements, SMS requirements, payment-provider rules, and merchant contracts.

Service description

MagiBooking is a website and mobile app owned and operated by Dragon Byte Design Inc.

MagiBooking is a booking and business management platform for nail, beauty, spa, massage, lash, and related beauty merchants. Features may include online booking pages, staff scheduling, client profiles, SMS and email reminders, deposits, memberships, coupons, reports, and mobile apps.

MagiBooking is not a beauty service provider. Merchants are responsible for service quality, pricing, refunds, cancellation policies, staff licensing, customer communication, and local operating compliance.

Accounts, customer data, and merchant responsibility

  • Merchants must provide accurate, reachable account, business, service, price, staff, and operating information.
  • Merchants are responsible for protecting passwords and staff permissions and must notify MagiBooking of unauthorized access.
  • Merchants must have a lawful source, reasonable purpose, and necessary consent before entering or collecting customer data through MagiBooking.
  • For health, allergy, medspa, massage, or other sensitive notes, merchants must obtain appropriate consent and restrict staff access.

SMS, payments, and subscriptions

SMS features send only login verification codes and transactional appointment or order confirmations, reminders, reschedules, cancellations, and merchant new-order alerts. MagiBooking does not send marketing or promotional SMS. Merchants must obtain and retain customer authorization before sending transactional SMS.

SMS consent disclosures must clearly state message type, frequency, Message and data rates may apply, STOP, HELP, SMS Terms, and Privacy Policy links, and must not be preselected. SMS consent is not a condition of purchasing MagiBooking or merchant services.

Mobile numbers, SMS opt-in data, and consent records may not be sold, rented, or shared with third parties or affiliates for marketing or promotional purposes. Merchants may not upload purchased lists, scraped numbers, or message non-consenting recipients.

Card and wallet payments are processed by Stripe, and Stripe charges its own processing fees. MagiBooking currently charges no marketplace commission, new-client fee, or per-booking platform fee; published subscriptions, SMS packages, additional staff, and other optional services still apply. Merchant-configured Zelle, Venmo, Cash App, cash/pay-in-store, and ERC20 USDT/USDC are merchant-directed methods, and the merchant is responsible for verification, records, refunds, taxes, and compliance.

Subscription fees, SMS allowances, extra staff, extra locations, migration, custom domains, white-label pages, AI phone, and training services are governed by website pricing, order pages, or written quotes.

Governing law, refunds, disputes, and merchant responsibility

To the maximum extent permitted by law, these terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. Disputes about the MagiBooking platform, subscriptions, billing, or accounts should be brought in a state or federal court with jurisdiction in New York, unless mandatory law requires another venue or process.

MagiBooking platform subscription fees, SMS packages, migration services, training, custom development, and other platform fees are generally non-refundable unless the order page, a written agreement, or mandatory law says otherwise. Refunds, partial refunds, deposit forfeiture, cancellation fees, chargebacks, and disputes between merchants and their customers are the merchant's responsibility under the merchant's published policy and applicable consumer protection law.

Merchants are responsible for clearly showing service prices, taxes, reschedule/cancel rules, refund rules, deposit rules, licensing, insurance, health/beauty/massage/medspa/pet-care compliance, staff authorization, privacy notices, and customer consent. MagiBooking is not the seller, employer, medical provider, beauty provider, or service provider for merchant services.

Merchants must independently handle customer complaints, service quality, in-person safety, licenses, taxes, cash collections, refunds, partial refunds, deposit forfeiture, chargebacks, dispute evidence, and regulatory inquiries. MagiBooking may provide recordkeeping tools, but does not assume responsibility for merchant service delivery.

Data processing and limitation of liability

For customer data imported, entered, or collected by a merchant through booking pages, the merchant is generally the controller or business, and MagiBooking acts as a service provider or processor under the merchant's instructions to provide booking, reminders, payment status, support, security, audit, billing, and compliance services.

Merchants must not upload data that was unlawfully obtained, lacks authorization, exceeds what is necessary, or contains sensitive data that should not be processed. Merchants should respond to their customers' access, correction, deletion, export, marketing opt-out, and SMS opt-out requests and contact MagiBooking when platform assistance is needed.

To the maximum extent permitted by law, MagiBooking is not liable for indirect, incidental, special, punitive, lost profit, lost revenue, lost goodwill, lost data, or business interruption damages. Except for liability that cannot legally be limited, MagiBooking's total liability for any claim is capped at the greater of the platform fees actually paid to MagiBooking during the three months before the claim arose or US$100.

Prohibited uses

  • No non-consensual SMS, harassment, fraud, phishing, fake bookings, fake reviews, or misleading marketing.
  • MagiBooking prohibits pornographic services or content, commercial sex, human trafficking, illegal services, unlawful facilitation, hate, firearms, tobacco, cannabis/CBD, gambling, debt relief, high-risk investment, and other platform-prohibited content.
  • No bypassing security, attacking systems, uploading malware, scraping others' data, or disrupting platform stability.
  • Do not use MagiBooking as a substitute for medical diagnosis, emergency services, financial advice, legal advice, or licensed professional judgment.

Mobile apps, availability, and contact

MagiBooking plans to offer iOS and Android apps. In-app support, privacy policy, account deletion, and user privacy choices will link to public pages on this website.

MagiBooking works to keep the system stable, but third-party payments, SMS, email, carriers, cloud services, app stores, or merchant networks may affect availability.
